Rise above petty dispute: Gujarat HC to GMERS

Gujarat High Court's division bench said that the Gujarat Medical Education Research Society (GMERS) must rise above petty dispute after the college withheld an MBBS graduate's documents as the student failed to pay INR 2 lakh bond amount.

Once again, Gujarat Medical Education & Research Society (GMERS) is in news for withholding the documents of an MBBS (Bachelor of Medicine and Bachelor of Surgery) graduate. 

GMERS withheld the documents of Dr Neel Patel as the student failed to pay INR 2 lakh bond amount. Rajesh Patel, the father of the student, approached the Gujarat High Court and urged the court to intervene on this matter as the student needed these essential documents to apply in the medical colleges in the US. The petition by the father also said that the bond amount was withheld for not undergoing rural tenure of one year.

The division bench of the High Court said that the medical college should “rise above such petty dispute”. Chief Justice Aravind Kumar said, “You want to scuttle the future of a candidate? Do you know this boy may one day become a Nobel laureate? He may become anything. You should be a welfare state, you are a medical college, (and) you should rise above all this… Suppose we accept all your contentions and direct him to pay the bond amount. He will pay the bond amount, (but) can he get back that one year?, ” as reported by The Indian Express.

The college submitted that the documents along with the covering letter will be brought to the court and it will be given to the petitioner in exchange of INR 3,500.

There was a similar case in Gujarat HC in September 2021, where also the court had said to return the documents of a student of GMERS 2015 batch whose documents were withheld by the state government due to non-payment of INR 2 lakh bond.
