The Delhi High Court has refused to give an urgent hearing to a PIL seeking direction to the private school in the national capital to waive off fees for the period when they are not fully operational due to the coronavirus nationwide lockdown.

In the wake of the coronavirus outbreak, educational institutions have been closed around the country since March second week. The PIL was filed seeking relief for the parents, who are undergoing financial crunch due to the lockdown implement in the country, to avoid further spread of the disease. The plea has also asked the court to give direction to the schools to not pressurize its students to pay fees or charges. The plea also mentioned giving direction to the Delhi government to provide sufficient funds to schools to bear their liabilities like the salary of staff and other expenses.

Social Activist and Advocate Amit Sahni mentioned the matter before the Registrar of Delhi HC for an urgent hearing in the matter, who did not find it sufficiently urgent.

“Although the government has directed everyone not to deduct salary of employees, private sector, particularly those working in the unorganized sector, are facing difficulties in paying school fees as many of them are not getting complete salaries and many are getting salaries after deduction. For instance, even some media houses have deducted the salary of their staff in order to face the financial crisis,” the petition stated.

The plea also said that the schools cannot compare the online classes given to the students with the actual physical classes as no other infrastructure is being used as schools are shut since March 2020.

The plea referred to the Haryana government, which has asked all unaided or private schools not to pressure its students or parents to deposit fees or charges till schools become operational and if any school does so, strict disciplinary action would be taken.
