Junior Resident doctors from ESIC approach SC for reservation in PG courses
Junior Resident doctors who have completed their MBBS from colleges run by ESIC have approached the apex court for reservation in PG courses.
The Junior Resident doctors who have completed their MBBS from institutions/hospitals run by the Employees State Insurance Corporation (ESIC) have approached the Supreme Court seeking to be included in the 50% "in-service" doctors reservation for medical PG courses, which is restricted to Insurance Medical Officers grade.
The bench of Justices AS Bopanna and Vikram Nath has scheduled the hearing for Friday, as reported by Live Law.
Plea Details
The petition stated, "Qualifications, entitlements, duties and responsibilities, as well as pay scale of junior resident doctors and IMO-II, are one and the same. Both officials are at par."
"Though Petitioners are similarly placed junior resident doctors like IMO- II they are not held to be eligible for said 50% quota of ESIC Hospitals. Thus the policy of ESIC is arbitrary and discriminatory which violates Article 14 of the Constitution. It is submitted that ESIC has been granting benefit of reservation to one set of in-service candidates and denying a said benefit to another set of in-service candidates when both are at par and similarly placed."
These Junior resident doctors have claimed that they are eligible "in-service" doctors of ESIC/ESIS for the purposes of inclusion in reservation for PG courses and sought direction to the respondents ESIC and others to extend the 50% "in-service" doctors reservation for PG courses to the Junior Resident Doctors serving in ESIC/ESIS.
