Karnataka Hijab Row: Wearing hijab is not an essential religious practice in Islam, says HC

Karnataka High Court has dismissed various petitions seeking permission to wear HIjab in education institutions. High Court rules that wearing a hijab is not an essential religious practice in Islam. It must be noted that a special bench was constituted to look into the issue.

Karnataka Hijab Row: Verdict

The three-judge bench comprising Chief Justice Ritu Raj Awasthi, Justices Krishna S Dixit and JM Khazi on Tuesday dismissed all petitions related to the hijab case.  HC in its verdict said that wearing of hijab by Muslim women doesn't form an essential religious practice under the Islamic faith, as stated by Live Law. HC bench also upholds the February 5, 2022 government order pertaining to dress code issued by the state government. Students can't object to uniform, ruled Karnataka high court.

The three-judge bench led by CJI Ritu Raj Awasthi observed, “Prescription of uniform is a reasonable restriction on fundamental rights and no case is made out for invalidating the Government Order of February 5.

The high court concluded the hearing related to the 'hijab' (scarf) case on February 25, but reserved its order. "Heard. Order reserved," Chief Justice Ritu Raj Awasthi said.

In order to maintain peace and harmony in the city, prohibitory orders under Section 144 of the Code of Criminal Procedure have been imposed in parts of Karnataka, including Bengaluru.

In Bengaluru, Police Commissioner Kamal Pant issued orders prohibiting all gatherings, protests and celebrations in public places from March 15 to 21. High Court officials held meetings with senior police officials on Monday evening.

The Karnataka High Court had earlier temporarily banned religious clothes, including Hijab and saffron scarves, last month as the controversy snowballed into protest demonstrations and several Muslim students being harassed by a section of students who turned up in saffron scarves, arguing they were also linked to religious identity.
