AIBE 19 Exam 2024: The Bar Council of India (BCI) is all set to conduct AIBE 19 (XIX) Exam 2024 on November 24, 2024. The application process for AIBE XIX Exam 2024 is underway and the last date to submit the AIBE 19 (XIX) Application Form 2024 is October 25, 2024. However, the BCI has come under scrutiny after 9 Delhi University law students challenged the council's decision to restrict final-year students from appearing in the All India Bar Examination 19. 

Meanwhile, the Supreme Court has sought a response from the BCI on a plea challenging the council's decision to restrict final-year law students. The decision was announced by the Bench led by CJI DY Chandrachud comprising Justices JB Pardiwala and Manoj Misra who were hearing a writ petition challenging the recent notification of BCI regarding AIBE 19 Eligibility Criteria 2024 that does not allow final year (final semester) law students from registering or appearing in the upcoming AIBE 19 Exam.

The Bench has directed the BCI's counsel to instructions from the council and reply by next week. Meanwhile, the BCI has informed the Apex Court that it is in the process of framing the procedure/rules for the AIBE Eligibility Criteria.The Counsel for the petitioners submitted, "My Lords already have the benefit of the Constitutional Bench decision." The Counsel appearing for the BCI further said that, as per the Constitutional Bench judgment, the council was to implement the procedure. "The Constitutional Bench Judgement on enrollment fees is also there—we are in the process of framing rules, we are collating and framing..," she said.

Based on the eligibility criteria, it appears that you may not be eligible to apply for the AIBE exam, as you have mentioned that you have secured 42% marks in your final LL.B. Exam. However, you may check with the respective State Bar Councils in your state, as the eligibility criteria may vary from state to state.

Q:   Can I apply for AIBE exams when my state bar council enrollment is under process.

A:

Yes, candidates can apply for AIBE exam if their enrollment process is in process. They are only required to provide enrollment number for AIBE application form. However, candidates will have to upload their enrollment Certificate once issued by their enrolled state bar council.

Q:   Who are exempted from AIBE?

A:

The All India Bar Examinations AIBE are conducted by the Bar Council of India to certify law graduates to practice in a court. The applicant who can fulfill the following criteria is eligible for the AIBE exam:
1. You have passed any law degree examination, be it a three-year LL.B. Course, a five-year LL.B. Course, or an LL. M.
2. You are eligible if you have obtained a passing percentage in your degree course.
3. There is no age limit, and you can appear for the AIBE exam at any age with your law degree.
4. The applicant must have an enrollment ID issued by the State Bar Council, from which you obtained your law degree.
