Disability Over 40% Shall Not Bar Students From Medical Course Admission: SC
The Supreme Court ruled that students with speech and language disabilities over 40% is not adequate grounds to deny admission to medical colleges owing to the response to the plea by a student who was denied admission to an MBBS programme because of 44-45% disability.
The Supreme Court has notified that a speech and language disability exceeding 40% shall not be a reason to deny admission to the medical college. The Apex Court has ruled that the current rule barring students with disability above the threshold shall be reconsidered and require a broader interpretation to ensure extensivity. The verdict was announced as an answer to the plea of a student who has disallowed admission to an MBBS program because of disability of 44-45%, as reported by TOI.
Reportedly, the Bench consisting of Justice BR Gavai and KV Viswanathan has mentioned that merely having disability of 44-45 per cent does not allow anyone to forfeit his right to be considered for admission. The bench also emphasises that the approach of the National Medical Commission (NMC) shall not be how to disqualify students from admission to medical courses. The Court expressed that an unreasonable binding of the law would hamper the faith and trust of differently-abled students in streamlining with mainstream society.
Reportedly, the court held that the candidate with a 45% disability should not be a reason to deny admission and each candidate should be evaluated individually. The Apex Court also expressed that the National Medical Commission (NMC) is expected to adopt a more broader approach by delivering reasonable lodgings for students with disabilities.
