Submit report on plea challenging NEET mandatory for homoeopathy courses: Delhi HC to Centre

The Delhi High Court has directed the central government to submit a response on the plea challenging the rule which makes NEET mandatory for admission into homoeopathy courses.

The Delhi High Court's two-judge bench of Acting Chief Justice Vipin Sanghi and Justice Navin Chawla has asked the Ayush Ministry, National Commission of Homeopathy, National Testing Agency and other involved parties to submit a response on the plea challenging the rule which makes NEET mandatory for admission into homoeopathy courses.

The petitioner is a group of homoeopathic medical colleges and it has challenged the legality of Section 14 of the National Commission for Homeopathy Act 2020 and information bulletin issued in July last year that made NEET compulsory examination for taking admission to homoeopathy courses, as reported by Live Law.

The petitioner's counsels including Advocated Animesh Kumar, Shweta Singh, Nishant Kumar and Rishabh Gupta have contended that the nature and subjects of modern scientific medicines and homoeopathy are totally different from each other, and hence NEET cannot be applied to homoeopathy.

NMC Act is applicable to modern medicine

The plea states, "NEET has been created by NMC Act which itself is applicable only to the Medical Institutions that grant degrees, diplomas or licenses in Modern Scientific medicine, which is different from Medical Institutions that grants degrees, diplomas or licenses in Ayurveda, Unani, Siddha or 20 Homoeopathy Medicines...if the main statute has itself restricted the scope of NEET to the extent of Modern Scientific medicine, then it cannot be extended to any other course by way of another Act without there being any authorization or amendment in the main Act for doing the same."
