Supreme Court has directed the government to maintain the status quo in the NEET PG 2021 mop-up round counselling till today.

While directing the Central government to maintain the status quo in the NEET PG 2021 mop-up round counselling till today, Supreme Court had asked the Director-General of Health Services (DGHS) to revisit the issues, including the decision of adding 146 new seats in the mop-up round. The court has asked the Centre to respond latest by today, March 31.

NEET PG 2021 mop-up round: Supreme Court's main concern 

146 new seats were added in GMCs in the NEET PG 2021 mop-up round, which was not available in Round 1 and Round 2. Also, lack of uniform application of the Medical Counselling Committee's (MCC) notice of March 16 which bars students to participate in the mop-up round if they have taken admissions in the state quota.

"As a consequence, students who were allotted seats in rounds 1 and 2 did not have the opportunity to participate in these 146 seats. A decision was taken that the new 146 seats will be included in the mop-up round," said the SC bench comprising Justice DY Chandrachud, Surya Kant and Bela Trivedi, as reported by Live Law.

Regarding MCC's March 16 notice, the candidates who got seats in Round 1 and Round 2 in the state quota are prevented from participating in the mop-up round under AIQ. Prima facie, it is observed that the notice has not been followed uniformly.

The petitioners have argued in the top court that March 16 notice is illegal as the State Quota Counselling guidelines permit candidates to cancel/surrender/resign from their allotted seats (with or without forfeiture) so that they can participate in any other round if they are so advised.
