AIBE 19 Exam 2024: The Gujarat High Court has issued an interim order directing the State Bar Council of Gujarat to provide provisional certificates for AIBE 2024 to students who have completed their LL.B. degrees from law colleges (CLE) not recognised by the Bar Council of India due to issues related to the payment of regularisation fees. This applies specifically to Government or Grant-in-Aid institutions in Gujarat. The Court's decision came in response to petitions from affected students seeking permission to sit for the All India Bar Examination, November 24, 2024.

Justice Aniruddha P. Mayee highlighted that there are other graduates in similar situations whose applications have not been processed, thus denying them the chance to take the AIBE 2024. The Court stated that it would be unjust for these law graduates, who may not have filed writ petitions, to be excluded from the opportunity to appear for the exam. Consequently, the interim order extends to all graduates from Government or Grant-in-Aid CLEs in Gujarat who are affected by this issue, allowing them to submit enrollment forms to the Bar Council of Gujarat, which must accept and process these forms for provisional certificates pending the outcome of the petitions.
The petitioners were represented by Advocate Mitul Shelat, while the respondents included Advocate Nidhi Vyas, AGP, and Senior Advocate Mehul Shah. The petitioners argued that their enrollment forms had not been processed, preventing them from appearing for AIBE 2024. Senior Counsel Mehul Shah indicated that the Bar Council of India had communicated that the petitioners might be allowed to take the exam, contingent on the current writ petitions, but that this should not set a precedent.
The Court has mandated the respondents to process the petitioners' enrollment forms and grant provisional certificates after proper verification by existing regulations, all while noting that this interim order was issued based on a concession from the Bar Council of India. The petitions were thus approved.
