The 17th session of All India Bar Examination popularly known as AIBE was held on February 5, 2023, for lawyers (or fresh law graduates) who are yet to obtain Certificate of Practice (COP). Candidates who appeared for the examination will be able to obtain COP once they have qualified AIBE as per the minimum marks criteria. The Bar Council of India will announce the results of AIBE 17 anytime soon, which will confirm whether a candidate has qualified the bar exam or not. Steps to check AIBE 2023 Results

Candidates must note that BCI will not send AIBE 2023 result via email or in offline mode. Candidates can check their AIBE 17 result on official website only by login.

    What is the procedure to obtain COP after AIBE 17 result?

    Candidates qualifying the bar examination will be able to obtain their Certificate of Practice directly from the state bar councils where they are enrolled for practice. They need to fill and submit the declaration form mentioning they have qualfiied AIBE 17, and now they are eligible to practice.

    If I get exactly the same marks as the qualifying/ minimum marks criteria, will I be considered as Pass for AIBE 17?

    According to the minimum marks criteria, candidates obtaining 40% of the total scores will be considered qualified, and 35% of total scores will be considered qualified. Therefore, candidates need to obtain:

    General/ OBC category - 40 marks or above out of 100 (if no question is deleted), and if a candidate obtains 40 marks, he will be considered as qualified, those obtaining 39 or less will be considered as FAIL. 

    SC/ST/PWD category - 35 marks or above out of 100 (if no question is deleted), and if a candidate obtains 35 marks, he will be considered as qualified, those obtaining 34 or less will be considered as FAIL.

    What has been the lowest cutoff for AIBE in the past years?

    According to revised answer key of AIBE 14, the lowest cutoff marks recorded was as under:

    AIBE 17 result incorrect details

    In case there are discrepancies with respect to details mentioned on AIBE 17 result, then the candidates have to verify their details and report the same on official email - aibe.bci@mail.com or contact the exam helpdesk at: 011-49225022, 011-49225023.

    The exam authority will check all the details and re-issue the result with correct details. For this, Candidates will be required to send attested copy of their relevant (if any) documents.

    AIBE 17 results and final answer key

    AIBE 17 results will be announced only after the exam authority verifies the objections recieved on the preliminary answer key. They will also revise the answer key with respective changes, and notify the change in final marks as well. 

    In case, there is any correction or removal of questions then it will affect the final marks.

    According to official website, the results will be announced only after 5 pm in the last week of February 2023 or first week of March 2023. The exam authority stated, "You are requested to check your result after XXth February 2023 5 pm"

    Will there be negative marking for wrong attempts?

    According to AIBE marking scheme, each question will carry 1 mark, and there shall be no negative marking for wrong attempts by candidates. The final marks will be out of total questions (found correct after answer key reviews) and questions correctly attempted by candidates.

    What are the details to be checked on AIBE XVII Results?

    Before downloading the result, candidates must check if the following details are correctly mentioned on AIBE 17 results: 

    • Candidate's Name, Roll number, Date of birth,
    • Candidate's Father/ Husband Name, and Category
    • Exam qualifying status - Pass or Fail
    • AIBE Registration Number
    • Candidate's Enrollment Number
    • Instructions for obtaining COP from SBC

    When will the State Bar Council issue COP?

    After recieving declaration forms from AIBE 17 qualified candidates, the state bar council will issue COP within 30 days. Candidates will have to visit their enrolled bar council to obtain the COP.

    Will there be AIBE 17 scorecard

    AIBE 17 results will only mention qualifying status such as PASS or FAIL, and candidates will not be informed about their marks. As the exam is of qualifying nature and not a competitive exam. They need not obtain highest marks from the total score, rather minimum qualifying marks as decided by the bar council.

    The Bar Council of India has not updated any information related to AIBE 17 answer key and result on the official website yet. Therefore, the result date of AIBE 17 is not confirmed.

    Can I send my AIBE 17 result to state bar council via email for obtaining COP?

    As per the instructions of BCI and state bar council, candidates will be required to submit the declaration form along with the copy of AIBE result in person. They also need to pay the applicable charges to obtain COP, which they will have to pay in offline mode only.

    Will BCI cancel my enrollment if I fail AIBE 17?

    The Bar Council does not cancel anyone's enrollment if they are not able to qualify AIBE exam. The candidates can continue their practise as per the validity period of their state bar council enrollment.     Will there be bonus marks for wrong questions, but I attempted these questions in the examination?

    The decision for awarding bonus for discrepted questions as found incorrect during answer key review is with the Bar Council of India. As per previous year trend, if there were questions found incorrect, then such questions were removed, and the total marking was reduced accordingly.

    Candidates may plead with their state bar council to extend their provisional enrollment until qualifying next session - AIBE 18. However, it will be completely at the discretion of Bar Council of India to allow this.

    The answer key, which the bar council will release after revision will affect the result of AIBE 2023 as under: 

    • If questions are removed, the final result will be evaluated without these dropped questions
    • The cutoff marks will be dropped from 40 for General/ OBC category and 35 for SC/ST/PWD category

    Why do I need to submit declaration form for AIBE COP, when I have already qualified the bar exam?

    The Bar Council of India has mandated the declaration form submission to all state bar council by qualified candidates. 

    As stated in an notification of BCI regarding the same, "The State Bar Councils are required to circulate the format of the Declaration Form to all the Bar associations. The Advocates can also download the same from the website of the Bar Council of India ic. www.barcouncilofindia.org and submit the format to their respective State Bar Council through their respective Bar Association or advocates can also submit the format directly to the State Bar Councils. NO PROCESS FEE is required to be submitted along with the aforementioned format. 

    In some Associations, those advocates enrolled after Verification Forms as per rules of 2015 such Advocate Declaration Forms for giving information as to whether they have passed A. I B. E.

    Two passport size photographs of the advocates are required to be attached along with the said Declaration Form."

    From where can I get declaration form to apply for COP after qualifying AIBE 17?

    Candidates can obtain the declaration form for AIBE COP from their respective state bar councils website or they can visit the state bar council in person to obtain it. Some SBC will require fee for issuing COP, but it would be of nominal only. 

    Candidates must note that the declaration form of COP must be for the current year, if they are downloading it from any website.

    How many times I can attempt AIBE? If I am unable to qualify this time

    Candidates are generally required to attempt and qualify AIBE within two years of provisional enrollment. But, there is no limit on number of attempts, even if this enrollement period is over. All persons who want to practise law in India must have COP issued to them by a state bar council, therefore, the limit on number of attempts for AIBE exam never levied.

The result for AIBE 17 for the reported test centre is like to be with-held, and the candidates allotted the reported test centre will be asked to re-appear for exam in next session.

    Pass percentage for AIBE exam is a analysis of total candidates qualified (out of total enrolled and registered) from each state bar council.     Can I check and download AIBE 17 result on mobile phone?

    Yes, candidates will be able to check and download their results for AIBE 17 on their mobile phones as well. They will be able to save their result as a pdf file for future references as required. In order to fill the declaration form along with a copy of AIBE result, candidates will be required to get a printout of the result page.

    Will BCI declare results for AIBE 17 in April?

    The exam authority will declare results within next 10 days as the exempted period for state bar council enrollment for many candidates will end in April 2023. To ensure that candidates continue practise without disruption, BCI will declare as early as possible.

    Can I obtain COP in online mode?

    Candidates who will qualify AIBE 17, will be able to obtain COP only after they submit declaration form to their enrolled state bar council. This process of obtaining COP from state bar council is still an offline mode process, therefore, obtaining COP in online mode is not an option. Last year, for AIBE XVI, BCI has launched a mobile application, AIBESCOPE to provide/ enable online AIBE COP download service for candidates. However, many candidates reported the application to be not helpful, and finally, they had to obtain COP in offline mode only.

    Why result of AIBE 17 will be withheld?

    The bar council may with-held result of AIBE 17 for the following reasons:

    • Cheating reported at any test centres
    • Details mis-match with application form and answersheet
    • Details missing on answersheet
    • Bio-metric verification incomplete (Although the exam authority has confirmed that it will declare results of all candidates even if biometric attendance was not done at the test centres)

    Will I be able to practise law without COP?

    According to BCI's laid down "provisions of Section 49(i) (ah) of the Advocates Act, 1961, which enable the Bar Council of India to frame rules prescribing the conditions subject to which an advocate shall have the right to practice and the circumstances under which a person shall be deemed to practice as an advocate in a court.

    Further,  After clearing All India Bar Examination, the candidate is awarded certificate of practice by Bar Council of India. Qualified member in the exam can attend court hearings in any tribunals courts and administrative bodies.

    The All India Bar Examination is a post-enrolment examination where persons are initially said to be provisionally enrolled on an undertaking that they will pass the exam within 2 years of said enrolment.

    Finally, in BCI Resolution dated 31.01.2017, it has been clarified that while the right to practice would only be for two years under a provisional enrolment, the said person can continue to take the Bar Examination as many times as is possible. The result therefore is that any person who is provisionally enrolled is allowed to practice for two years, but is allowed to take the exam not just for two years but for any number of times till he passes the exam while the date of reckoning seniority is from the date of the provisional enrolment." 

    Therefore, a lawyer enrolled with state bar council may be able to participate in legal formalities of a court without COP till 2 years after enrollment (with exemption period). However, to continue practise or enter into litigation he/she must be a certified lawyer, which is possible only after they obtain COP from their respective state bar councils.

    How can I know my marks for AIBE?

    As All India Bar Examination result is announced with only qualifying status PASS or FAIL, candidates never get to know their marks. But, if they want to know their marks obtained in AIBE 17, then they can write an email to the exam authority requesting the same.

    Is there any fee for AIBE result rechecking?

    Candidates applying for AIBE 17 result re-checking will be required to pay nominal fee of INR 200 as the rechecking process fee. They will be able to pay this fee in online mode only when filling up the application for rechecking of AIBE result.

    Could not qualify AIBE 17 - For how long one can practise?

    In case, any candidate is not able to qualify AIBE 17, then he/she will be allowed to practise with their enrolled courts, till the completion of two years of their enrollment (including exemption period as resolved on December 30, 2022, that period from October 31, 2021 to April 2023, will be counted within 2 years of enrollment of a candidate). Once this period is complete, candidate will have to enroll again and qualify the next AIBE exam i.e. 18th session.

    AIBE 17 result status is FAIL/WITH-HELD, can I apply for rechecking?

    AIBE 17 result rechecking window may be provided to candidates only at the discretion of the Bar Council of India. The candidates will be able to apply online for AIBE result rechecking, if there result status shows FAIL/ WITHHELD. However, the AIBE 17 result rechecking facility will be provided few days after the result declaration, and not right after it.

    AIBE result qualifying marks

    The exam authority has informed candidates that they need to obtain 40% of total marks (35% in case of SC/ ST/PWD) to qualify the bar examination, AIBE. There can be a drop in the qualifying marks if total questions from the paper are reduced. However, the cutoff marks/ minimum qualifying marks will not increase.

    AIBE result correction

    As informed by BCI, "If any candiate of AIBE 17 held of 05.02.2023 has missed out on biometric attendance they need not worry, so long as their verification was done in the classroom while giving the exam by way of taking their signatures. Their answer sheets will be taken into account and their results will be duly declared when result of the examination is declared."

    This means, AIBE 17 results for all candidates who appeared for the examination will be declared, irrespective of incorrect details on the answer sheet or incomplete Biometric Attendance Process (which was a mandatory for all test centres, but was missed at few test centres).
