AIBE 19 Exam 2024: The Bar Council of India (BCI) has begun the AIBE Application Process 2024. Candidates can apply for the AIBE 19 (XIX) Exam 2024 on or before October 25, 2024. AIBE 19 Exam Date 2024 is November 24, 2024. Recently, a writ petition has been filed in Apex Court challenging the BCI notification regarding the All India Bar Examination (AIBE) which restricts final-year law students from appearing in the AIBE XIX Exam. 

The plea challenging the AIBE 19 Eligibility Criteria has been filed by 9 final-year law students at Delhi University. The matter will be headed by the Bench led by CJI DY Chandrachud comprising Justices JB Pardiwala and Manoj Misra on September 13. The petitioners said that the impugned notification is in contrast to the decision of the Top Court in Bar Council of India v. Bonnie FOI Law College where a Constitution Bench observed that the final semester students be allowed to sit for the AIBE (subject to clearing their law degree). It also directed the BCI to hold the AIBE exam twice a year. 

The students in their plea also argued that AIBE 19 Notification bars them from appearing in the upcoming bar examination which will lead to loss of their valuable time in pursuing their professional careers. "The notification is arbitrary and unreasonable as it overlooks the different schedules of universities is declaring their results and adversely impacts those students whose results declaration is delayed," the plea stated.

The plea asked for the following reliefs: (1) quashing of the BCI notification; (2) direction to allow final semester students to appear in the upcoming exam and (3) interim stay on the impugned notification.  The petition has been filed with the assistance of AOR A Velan and Advocate Navpreet Kaur.

Q:   I have 42% marks in my final LLB exams. Can I apply for AIBE exam? Am I eligible?

A:
Based on the eligibility criteria, it appears that you may not be eligible to apply for the AIBE exam, as you have mentioned that you have secured 42% marks in your final LL.B. Exam. However, you may check with the respective State Bar Councils in your state, as the eligibility criteria may vary from state to state.

Q:   Can I apply for AIBE exams when my state bar council enrollment is under process.

A:

Yes, candidates can apply for AIBE exam if their enrollment process is in process. They are only required to provide enrollment number for AIBE application form. However, candidates will have to upload their enrollment Certificate once issued by their enrolled state bar council.

Q:   Who are exempted from AIBE?

A:

The All India Bar Examinations AIBE are conducted by the Bar Council of India to certify law graduates to practice in a court. The applicant who can fulfill the following criteria is eligible for the AIBE exam:
1. You have passed any law degree examination, be it a three-year LL.B. Course, a five-year LL.B. Course, or an LL. M.
2. You are eligible if you have obtained a passing percentage in your degree course.
3. There is no age limit, and you can appear for the AIBE exam at any age with your law degree.
4. The applicant must have an enrollment ID issued by the State Bar Council, from which you obtained your law degree.
