AIBE 19 Exam 2024: The Supreme Court has announced a major decision related to the eligibility criteria of All India Bar Examination 2024. The AIBE 19 Exam 2024 is scheduled to be held on November 24, 2024. The SC has given nod to the final-year law students to appear for AIBE 19 (XIX) Exam 2024. The Apex Court passed the interim order while hearing a plea challenging the AIBE 19 Eligibility Criteria 2024 announced along with the AIBE 19 Notification 2024. 

The BCI in its notification restricted the final year students from appearing in AIBE Exam 2024. The petitioners approached the SC stating that the BCI's decision was contrary to the Constitution Bench judgment in Bar Council of India v. Bonnie Foi Law College & Ors as per which final year law students should be allowed to appear in the AIBE.

In today's hearing, the bench comprising Chief Justice of India DY Chandrachud, Justice JB Pardiwal and Manoj Misra, the Bar Council of India informed them that they need some time to frame rules regarding final year law students. The bench, however, said that they can take time to frame rules, but should ensure that final year law students do not lose a year.

The bench clarified that the order will apply to all final-year law students and not just to the petitioners. "We direct that the BCI shall permit the registration of all students who fall within the ambit of Paragraph 38 of the Bonnie Foi Decision. The above direction to operate in rem for AIBE scheduled for November 24," the bench announced.

"We are inclined to accept the suggestion from the learned Amicus that students who have cleared all examinations to be eligible to pursue the final semester of the final year course of law, on production of proof of the same, could be allowed to take the All India Bar Examination. The result of the All India Bar Examination would be subject to the person passing all the components required under the course of study of the University/College. This would be subject to the All India Bar Examination results being valid for a specified period of time," the bench added.

Q:   I have 42% marks in my final LLB exams. Can I apply for AIBE exam? Am I eligible?

A:
Based on the eligibility criteria, it appears that you may not be eligible to apply for the AIBE exam, as you have mentioned that you have secured 42% marks in your final LL.B. Exam. However, you may check with the respective State Bar Councils in your state, as the eligibility criteria may vary from state to state.

Q:   Can I apply for AIBE exams when my state bar council enrollment is under process.

A:

Yes, candidates can apply for AIBE exam if their enrollment process is in process. They are only required to provide enrollment number for AIBE application form. However, candidates will have to upload their enrollment Certificate once issued by their enrolled state bar council.

Q:   What is the AIBE 19 Minimum Passing Criteria 2024?

A:

To qualify in the AIBE 2024 exam, general category candidates need to secure 40% marks, while SC/ST candidates need 35% marks. Note that the total marks will only be known after the final answer key is released, as if any wrong questions are found then they may be rejected.
