NEET 2025: Delhi HC Declines Petition to Conduct Medical UG Exam Twice A Year; Cites Administrative Authority

The bench comprising Chief Justice D.K. Upadhyaya and Justice Tushar Rao Gedela's bench cited that the NEET UG exam sessions in a year are under the government's jurisdiction in which the court had no jurisdiction.
The Delhi High Court has dismissed a petition asking for the National Eligibility cum Entrance Test (NEET) Undergraduate (UG) exam to be held twice a year, like the Joint Entrance Examination (JEE) Main for engineering students. The court said that decisions about exam frequency are part of government policy and not within its jurisdiction.
The bench, led by Chief Justice D.K. Upadhyaya and Justice Tushar Rao Gedela, clarified that the decision to hold NEET UG more than once a year is an administrative and policy matter, which is not for the court to decide, as reported by India Today.
βIt is for the authorities to consider the prayer. Thatβs a policy decision by the government,β the bench stated while disposing of the petition." The bench stated.
Delhi High Court Allows Petitioner's Request to Be Heard by Authorities
The court also allowed the petitioner, a coaching centre teacher, to approach the relevant authorities with a formal request. If the petitioner does so, the authorities shall consider it and make a decision according to the law.
The petitioner argued that the JEE (Mains) exam is conducted in multiple shifts that allow candidates to have several opportunities to reduce stress and improve their scores in the later attempt. Whereas, candidates taking the National Eligibility cum Entrance Test (NEET) (UG) are only given one chance per year. The petition urged that NEET candidates should also be provided with multiple opportunities so that have the opportunity to improve scores, reduce stress, have flexibility and better understanding of the exam pattern.
