SC to hear appeal against Kerala medical education admission act today

Supreme Court will hear today the appeal of Nair Service Society against the high court order related to the amendment to Kerala law on medical admissions.

After the high court rejected the plea of the Nair Service Society (NSS) against the 2017 amendment to state law on admissions into medical courses in Kerala, now Supreme Court will hear today the appeal of NSS against the high court order in this matter. A bench of justice DY Chandrachud will consider the case today.

NSS appealed that the private aided and unaided institutions cannot be treated in a similar manner.

The objection of Nair Service Society

Kerala Medical Education (Regulation and Control of Admission to Private Medical Educational Institutions) Act, 2017, allowed the Fee Regulatory Committee to review the documents of students who take admission to the 15% management quota seats and clause 2(P) says that the law is applicable to both private aided and unaided colleges of the state. NSS objection is that both these types of institutes cannot be treated alike. The petitioner also claimed that the law is a violation of the verdict of TMA Pai Foundation vs the State of Karnataka, as reported by Mathrubhumi.

NSS general secretary G Sukumaran Nair, and ANSS Homoeo Medical College principal Dr C Bindukumari pleaded that the committee has complete authority over the management quota admissions.

The Commissioner of Entrance Examination (CEE), Thiruvananthapuram is the conducting body for MBBS/BDS admission in Kerala. The registration process for admission to medical and dental colleges in Kerala is conducted in two phases- phase 1 and phase 2. Phase 1 registration closed on May 10 while the last date for the phase 2 registration process was closed on July 26, 2022.
