Amid the ongoing challenging situation that students are facing due to the COVID-19 pandemic, the Court ordered striking down the clause in CBSE policy

CBSE 12th Results 2022: The Central Board of Secondary Education (CBSE) had said that the marks obtained in the Class 12 improvement examination shall be considered as final even if the marks obtained in the original exam were more than in the improvement exams. However, the clause has been struck down by the Supreme Court during the hearing of a plea filed against the Board.

CBSE has been directed by a Bench of Justices AM Khanwilkar and CT Ravikumar to consider the better of the marks in the two exams for evaluation of results of class 12 exams. The order released against CBSE stated, “We have no hesitation in striking out the policy where marks scored in the later examination will be considered final. CBSE shall provide an option to the candidate to choose better of the two marks obtained for the subject for the evaluation of results.”

The Board had previously allowed students to retain the marks in the original exam if the marks scored in the improvement examination were lesser.

Questioning CBSE, the court said, "Give us a justification why is it not possible to accept the favorable marks of the candidate. In the past, you've done it. What's the difficulty in doing it this year also?”

The Court then proceeded to pass an order noting that the present policy was in a departure from the earlier one which allowed better marks of candidates to be considered. Amid the ongoing challenging situation that students are facing due to the COVID-19 pandemic, the Court ordered striking down the clause in CBSE policy.
