Delhi govt approaches SC against LG's decision prohibiting teachers training in abroad

The plea by the Delhi government against Lieutenant Governor (LG) VK Saxena’s decision was mentioned before the bench of Chief Justice of India (CJI), DY Chandrachud.

The government of Delhi has approached the apex court of India, the Supreme Court against Lieutenant Governor (LG) VK Saxena’s decision, which prohibits government school teachers from receiving foreign training in the future. Recently, sending government school teachers for training in Finland became yet another flashpoint between the AAP government and the LG.

The plea by the Delhi government against Lieutenant Governor (LG) VK Saxena’s decision was mentioned before the bench of Chief Justice of India (CJI), DY Chandrachud. “LG is now deciding which teachers to send, how to send them, and when to send them for teachers’ training programmes. He has also said that no such proposals will be entertained in the future,” said Singhvi, after which the CJI assigned the matter for hearing on April 14. Senior Advocate Abhishek Manu Singhvi will represent the Delhi government in the Apex Court.

The plea sought direction to set aside the order passed by the LG on March 4 and affirm the proposal of the Delhi government’s State Council of Educational Research and Training (SECRT) to send primary teachers at government schools abroad for training.

In a statement issued by the Delhi government, it claimed that “The elected government of Delhi had to file the present petition due to the unwarranted and deliberate delay caused by the lieutenant governor in approving the proposal to send primary in-charge teachers of government schools in Delhi for teacher’s training to Finland in the months of December 2022 and March 2023.”

It further said, “In this context, Delhi Government is seeking a re-declaration of the well-settled position of law that the governor is bound to act on the aid and advice of the council of ministers and has no independent decision-making power.”

Asserting that the governor has assumed the role of the “appellate authority”, the government said, “The government has argued that by imposing the conditions/amendments, the Lieutenant Governor has illegally and unconstitutionally assumed the role of an appellate authority.”
