The petition has been filed on behalf of the petitioner’s child who is 5 years (9 months) in age. The petition alleges that the age guidelines were uploaded four days before the admission process began.

KVS Admissions 2022: The admission criteria for the Kendriya Vidyalaya Admissions 2022 has been challenged in the Delhi High Court. Began on February 28, KVS admissions 2022 process began with the registrations for students of Class 1. The petitioner has challenged the minimum age criterion specified for seeking admission in KVS. According to the information available on the official admissions portal, for KVS admission in Class 1, the student must be at least 6 years old.

The KVS Admissions 2022 guideline handbook states, “A child must be 6 years old as on March 31 in the academic year in which admission is sought for Class 1. (Children born on April 1 will also be considered).”

Stating that this criterion is a direct violation of the Right to Education Act 2009. In 2021-22, the child was enrolled in Upper Kindergarten (UKG or KG2). The petition has been filed on behalf of the petitioner’s child who is 5 years (9 months) in age. The petition alleges that the age guidelines were uploaded four days before the admission process began. The age criterion shocked the petitioner as the guidelines made their child ineligible to apply for Class 1 in Kendriya Vidyalaya for the session of 2022-23.

"All of a sudden, respondent KVS has made changes in the minimum age criteria for admission in Class 1 from 5 years to 6 years by uploading the impugned guidelines on portal.kvssangthan.nic.in, just four days before the admission process which was to begin on February 28, 2022. The petitioner was shocked to find out by the impugned guidelines that they have been made ineligible to apply for Class 1 in respondent KVS in the academic year of 2022-23," stated the petition filed in the Delhi HC.

HC sent a legal notice to Kendriya Vidyalan Sanghtan on February 27, 2022. In response to this, KVS officials said that the authority has to make changes in the minimum age criterion due to the implementation of NEP 2020. Three years of primary schooling have been added, hence the age for Class 1 has been changed to 6 years.

The regular 10+2 system has been changed to the ‘5+3+3+4’ system of education under the National Education Policy 2020. According to the policy,  a child must complete three years of anganwadi or KG classes and then Class 1 and Class 2 in the first five years of his/her education. KVS changed the age requirement due to this change in the system.
