BCI conducted AIBE 18 Exam 2023 on December 10, 2023. The BCI revealed the information while answering a query sent by Advocate Shibu Babu, who had raised several concerns that included the AIBE Exam frequency, AIBE Registration Process, Why AIBE Exam was recheduled repeatedly and others.

AIBE 18 Result 2023: The Bar Council of India under the Right to Information (RTI) Act has informed that only 48.36 per cent of candidates were able to pass All India Bar Examination 2023. BCI conducted AIBE 18 Exam 2023 on December 10, 2023. The BCI revealed the information while answering a query sent by Advocate Shibu Babu, who had raised several concerns that included the AIBE Exam frequency, AIBE Registration Process, Why AIBE Exam was recheduled repeatedly and others. 

He also asked the testing agency to share the number of candidates who had registered for the AIBE 18 Exam, how many appeared, passed and failed. The BCI in a reply said that "a total of 1,48,781 candidates had registered for the exam, out of whom 1,44,014 appeared. Out of the people who appeared, 69,646 (48.36%) passed and 74,368 (51.64%) failed."

While clarifying on the frequency of the AIBE Exam, the BCI said that as per the rule AIBE has to be conducted twice a year, however, it could not be conducted as per the schedule due to the COVID-19 pandemic. The BCI has also said that on the basis of the decision of the High-Level Monitoring Committee, 7 questions were removed from AIBE 18 Question Paper 2023.

The BCI however did not answer all the queries citing the Supreme Court's decision in CBSE and Anr v. Adhitya Bandopadhyay and Ors to assert that the information sought was not 'information' as defined under the RTI Act. The SC in this judgement further held that a public authority is not required to furnish information which requires drawing of inferences, or making of assumptions, or which qualifies as an advice or opinion.
