MP HC Orders Increase in Private College MBBS Seats to Facilitate EWS Reservation

The Division Bench of the High Court, led by Chief Justice Suresh Kumar Kait and Justice Vivek Jain, emphasized that the absence of provisions for EWS seats in private medical colleges violates the 103rd Constitutional Amendment, which ensures a separate quota for EWS candidates.

Madhya Pradesh High Court asked the state government to increase private medical college MBBS seats in order to provide reservations for the Economically Weaker Section (EWS). The Division bench of the HC comprising Chief Justice Suresh Kumar Kait and Justice Vivek Jain asked the reason for no provision for EWS seats in private medical colleges under the admission rules framed and how it violated the 103rd amendment providing a separate quota for EWS students, as reported by Medical Dialogues. 

The Court made these observations while evaluating the plea of Atharva Chaturvedi, a student from Jabalpur, an EWS student who secured 530 out of 720 percentile scores in the National Eligibility-cum-Entrance Test (NEET). As a consequence, the HC panel granted the State a year to finish the infrastructure along with additional formalities until the seats increased.

Petitioner's Application Denied 

While government school quota general category students and NRI candidates with lower scores got accepted into private medical institutions, the petitioner student was denied admission. The petitioner challenged the state government's notification concerning the admission rules for medical colleges. He argued that the same reservation is available in government medical colleges, but EWS seats were not reserved in private medical colleges.

The petitioner further stated that notwithstanding the Central Government's 2019 notification in this regard, the Madhya Pradesh Government did not follow the admission rule. Consequently, EWS applicants were denied admission to a private medical institution.

On the contrary, the State Government contended that all NEET aspirants were well aware of the regulations. Furthermore, the State contended that laws regarding admissions could not be altered at this stage because the admissions procedure for this academic session had been finished.
