NEET PG: Supreme Court Issue Notice on Plea Seeking Release of Question Paper, Answer Key

The Supreme Court on Thursday issued a notice on a plea seeking directions to NBE to release the question paper and answer key of the NEET PG exam. 

Supreme Court Verdict on NEET PG

The vacation bench presided over by Justice Vikram Nath and Justice SVN Bhatti agreed to examine the plea and seek a response from the National Board of Examinations (NBE), Medical Counselling Committee (MCC) and others on the matter. 

“Issue notice returnable on 8th of July, 2024. In the meantime, respondents may file their counter affidavits,” ordered the Bench.

During the hearing, The legal authorities of the National Testing Agency (NTA) mentioned that It could be excluded from the list of litigants since it is not a required party to the lawsuit. The National Eligibility Entrance Test for Postgraduate is conducted by the National Board of Examination, submitted by NTA's counsel. 

Consequently, Justice Bhatti responded saying “You may put it on record. When we pass an order, we will use our discretion under Supreme Court rules and delete you from the array of parties.”

What Is the Issue? 

A petition was filed in the Supreme Court seeking attention towards the NBE's rule of not releasing the NEET PG question paper and answer key. The petition submitted directly before the Supreme Court criticized the NBE's "arbitrary act and decision" of not releasing the question paper, answer key, and answer sheet for the NEET PG exam for the year 2022 and not allowing any option to re-evaluate the score, despite knowing that there were "serious discrepancies" in the scores of candidates who appeared for the exam in recent years.

The plea further highlighted that no other entrance exam in India lacks such transparency and a one-sided flow of information as NEET PG. NEET UG, JEE Advanced, CMAT, and CLAT are also national-level entrance exams that allow students to challenge the answer key, so why not NEET PG?
