Rajasthan HC issues notice on plea challenging MCI condition on Foreign Medical Students
The Jaipur Bench of Rajasthan High Court has issued a notice on plea challenging Medical Council of India (MCI) regulations for foreign medical students requiring them to complete mandatory 54 months of medical education for practising in India.
The Rajasthan High Court's Jaipur Bench has issued a notice on plea challenging Medical Council of India (MCI) regulations that require a mandatory minimum 54 months of medical education for permanent medical registration in India.
The court has issued the notice while hearing the plea filed by a medical student who is pursuing a medical course from an institute in the Philippines. She has claimed in her plea that her institution is recognized as per Section 39 of the National Medical Commission Act, 2019.
The plea has challenged the MCI's new regulations with the name National Medical Commission (Foreign Medical Graduate Licentiate) Regulations 2021, in which regulation 4 says that no foreign medical student will be given permanent registration unless he/she has completed the foreign medical degree with at least 54 months duration.
As per the petitioner, her course duration is of 48 months and hence as per this rule, she will not be able to get permanent medical registration in India.
Her counsel has argued that regulation 4(a)(i) is ultra vires since it travels beyond the scope of the 2019 Act and is in conflict with Section 36 thereof, as reported by Live Law.
The court has issued notice on the plea and the matter is scheduled for hearing on March 22.
