To practice law, all State Bar Council enrolled advocates have to qualify AIBE exam by Bar Council of India. Read detailed notification released by Delhi Bar Council for advocates who could not qualify AIBE.

Bar Council of Delhi has barred 4778 provisionally enrolled advocates who could not qualify All India Bar Examination (AIBE) since 2010. The official notification also states that these advocates cannot practice law until they qualify AIBE. The council has also asked all the regional courts, tribunals and bar associations not to allow such advocates to appear before the Hon’ble court, or even vote in any bar election.

AIBE XIV is scheduled to be held on September 15, 2019 and the admit card will be issued to only those advocates who applied before the last date of application i.e. September 8, 2019 (extended after special request of State Bar Councils).

As per the exam pattern of AIBE, there will be 100 multiple choices based questions of one mark each. The exam will be held in pen-paper based test mode for a duration of 3 hours 30 minutes. The question paper based on 19 subjects of law and it will be available in 11 languages, the test taker can take the exam in their preferred test medium. Moreover, there is no negative marking in case of wrong attempts.

Advocates who could not register for AIBE XIV can appear for the next session as the exam is held twice a year.

Below is an excerpt from Delhi Bar Council circular for ‘Non-Passing of All India Bar Examination’:

  This is to inform you that as per the record received from Bar Council of India (BCI), which is responsible for conduce of All India Bar Examination (AIBE), since 2010, a total number of 4,778 advocates provisionally enrolled, have failed to qualify the said examination, as per Bar Council of India (AIBE) Rules 2010.
According to BCI Circular BCI:D: )5/& /STBC CIR. NO. 4/2013(COUNCIL) dated 12.4.2013 “It is also made clear that those who do not pass the AIBE within the said period, will not be given further such provisional certificates till they pass the AIBE, and will be ceased to be the advocate till they pass AIBE. After getting success in AIBE, the State Bar Councils shall issue certificates of enrollment and the candidates shall return their provisional certificates to State Bar Councils, the State Bar Councils shall issue certificate/licence only after verifying the Certificate of Practice (COP) issued by Bar Council of India duly signed by Chairman, Bar Council of India and Chairman of concerned State Bar Councils.”
You are, therefore, requested not to allow all such advocates to appear before the Hon’ble Court or to vote in any Bar election.
