A vacation bench of Justices M R Shah and Aniruddha Bose asked the petitioners' counsel to serve a copy of the petition to the Medical Counselling Committee (MCC), National Board of Examination, and the Centre.
βLet the advance copy of the petition be served on Ms. Aishwarya Bhati, Additional Solicitor General who may get instructions in the matter. The petitioner may serve one advance copy of the petition in the Central Agency also,β the bench said, as reported by NDTV.
Plea Details
"Occupying remaining seats (on the basis of merit) works in the interest of both the college as well as candidates. While the college would refrain from incurring heavy losses in each vacant seat, the candidates will also lose a seat, which they are otherwise deserving of," stated the plea, as reported by Live Law.
The plea also added that in various examinations including INCET, efforts are made to ensure that there is no wastage of seats. Spot on option is given in INCET to fill the remaining seats and even in DNB courses, this option was given by the National Board of Examination till last year.
The petition has been filed through AOR Milind Kumar and the petitioners were represented through Dubey Law Chambers.
