A group of parents has moved the Supreme Court against the CBSE decision to conduct the remaining class 10th and 12 examinations in July, amid the ongoing coronavirus pandemic.

A group of parents has approached the Supreme Court against the Central Board of Secondary Education (CBSE) decision to conduct the pending Class 10th and Class 12th exams from July 1 and urged the court to direct the Board to mark students on the basis of internal assessment in view of coronavirus pandemic.

Alleging that students will be exposed to the pandemic if they appear for the examination to be conducted at 15,000 exam centres, a group of parents pleaded to the court to intervene and stay the decision.

The petition, filed by advocate Rishi Malhotra, contended that many reputed educational institutions and Universities including IITs and Delhi University has decided not to conduct examination keeping in mind the safety of the students and CBSE should also be directed to not conduct the examination for the remaining subjects.

He also stated that some state Boards including Chhattisgarh have also decided against holding any examination to protect students from being exposed to the deadly virus.

"CBSE's notification for holding of the remaining examination is discriminatory and arbitrary and that too in the month of July wherein as per the AIIMS data, the said COVID-19 pandemic would be at its peak. As done by CBSE in its other 250 schools abroad and various State Boards, the examination scheduled to be conducted in July, should be cancelled and the marks could be allotted on the basis of internal assessment," the petition said.

"CBSE cancelled the examinations of Class 10th and 12th for its 250 odd schools which are situated abroad and has adopted criteria in awarding marks on the basis of either practical exams conducted or internal assessment marks. It is highly regretful that the respondents herein have no genuine concern about putting the lives at peril of all the students pan India and have no explanation whatsoever in insisting upon holding the said examination in India," it said.

The Board will be conducting the remaining CBSE 10th exam for a section of students in North-East Delhi in July along with  CBSE 12th exams 2020 from July 1 to 15. On May 18, CBSE had released the revised Class 10 date sheet 2020 and CBSE Class 12 date sheet 2020.

Due to the coronavirus outbreak, CBSE had postponed the Class 10 and 12 exams in the country.  This is the first time, that the Board will be announcing the  Class 10 Results and  Class 12 Result by mid-August.
Meanwhile, the Union Human Resource Minister Ramesh Pokhriyal Nishank has announced that the Board is expected to declare CBSE 10th Result 2020 and  CBSE 12th Result 2020 by August 15. These include the results of previous exams and the results of examinations in July.
