The Bar Council of Gujarat is an "Autonomous Statutory Body" that was formed on August 16, 1961, under the Advocates Act, 1961 to represent lawyers practicing law in Gujarat. It holds significant powers, duties and functions to comply with its statutory duties as per the Advocates Act, 1961, the Gujarat Advocates’ Welfare Fund Act, 1961 and the rules formed and imposed by the "Bar Council of India." As per Section 6 of Advocates Act, 1961, the Bar Council of Gujarat has the following functions: 

1. The functions of a State Bar Council shall be:

  • To admit persons as advocates on its roll;
  • To prepare and maintain such roll;
  • To entertain and determine cases of misconduct against advocates on its roll;
  • To safeguard the rights, privileges and interests of advocates on its roll;
  • To promote the growth of Bar Associations for the purposes of effective implementation of the welfare schemes referred to in clause (a) of sub-section (2) of this section and clause (a) of sub-section (2) of Section 7;]
  • To promote and support law reform;
  • To conduct seminars and organise talks on legal topics by–eminent jurists and publish journals and papers of legal interest;
  • To organise legal aid to the poor in the prescribed manner;
  • To manage and invest the funds of the Bar Council;
  • To provide for the election of its members;
  • To visit and inspect Universities in accordance with the directions given under clause (i) of sub-section (1) of Section 7
  • To perform all other functions conferred on it by or under this Act,
  • To do all other things necessary for discharging the aforesaid functions.

3. A State Bar Council may receive any grants, donations, gifts or benefactions for all or any of the purposes specified in subsection (2) which shall be credited to the appropriate fund or funds constituted under that sub-section.

Q:   I have 42% marks in my final LLB exams. Can I apply for AIBE exam? Am I eligible?

  1. Register with the Bar Council of India: You need to register yourself with the Bar Council of India by submitting the AIBE scorecard, your law degree Certificate and other relevant documents. You will also need to pay the registration fee and fulfill any other requirements specified by the Bar Council of India.
  2. Apply for the Certificate of Practice: After registering with the Bar Council of India, you can apply for the Certificate of Practice by submitting an application along with the required documents such as your identity proof, address proof, and a declaration that you have not been convicted of any criminal offense or professional misconduct.

Documents Required for Registration with the Bar Council of Gujarat

Before enrolling in the Bar Council of Gujarat, you must have the following documents:

  • Class 10th marksheet and passing certificate
  • Class 12th marksheet and passing certificate
  • Employment certificate (if required, only for those who are / were working professionals)
  • 3-year / 5-year LLB marksheet and passing certificate
  • Latest passport-size photo in formal attire of a lawyer
  • Photo ID proof such as an Aadhaar Card, Passport or PAN Card
  • Self-attested address / residence proof
  • Rent agreement (only for those who live in a rented house in Gujarat and have the signature of their landlord on the copy of the rent agreement)
  • An affidavit justifying the gap between the passing year of a 3-year / 5-year LLB and the year of enrollment in the Bar Council of Gujarat (if any gap is there).

The passing marks for the All India Bar Examination are decided after the revised answer key for the All India Bar Examination is published. A:

The minimum passing percentage for general category candidates in AIBE 19 is 45 per cent. As per the information provided, the cutoff marks for General/OBC category is 45 marks out of 100. The BCI has increased AIBE cutoff from 40 per cent to 45 per cent for general category candidates.  The AIBE cut-off marks is the minimum marks (or percentage) that candidates need to obtain in their category to clear the certification exam.

However, as per the recent BCI Notification, candidates who do not possess enrolment certificates, as well as those currently in their final semester of a 3-year or 5-year integrated LLB degre course with no backlogs from previous semesters are now allowed to appear for the upcoming AIBE. 

Q:   How many attempts are allowed for the AIBE exam?

A:
The number of attempts for the All India Bar Examination is unlimited. Students can appear for the All India Bar Examination exam consecutively till they qualify it. However, they must qualify for the exam within two years of provisional enrolment with the State Bar Council. If they fail to do so then they will be required to re-enroll with State Bar Council.
